I do not consider that, in order to determine Ground 1, I should attempt a definitive analysis of what it means for all issues arising in proceedings before the First-tier Tribunal to be finally disposed of. As I shall now explain, the structure of the 2008 Rules renders that unnecessary.
Under rule 10(5) of the 2008 Rules, certain specified events start time running for making a costs application. The only one of relevance in this case is the sending by the Tribunal of a “decision notice recording the decision which finally disposes of all issues in the proceedings”. I must construe rule 10(5) not in isolation, but in the light of the entirety of the Rules (Secretary of State for Work & Pensions v Johnson [2020] EWCA Civ 778; [2020] PTSR 1872). In that respect, I note:
