The Secretary of State appeals against the FTT’s decision and so is now the Appellant in the current appeal before the Upper Tribunal while the claimant is the Respondent. To avoid any confusion occasioned by their reversal of roles in these proceedings, I refer to them in this decision as the Secretary of State (or the DWP) and the claimant respectively.
