District Tribunal Judge Ly found that the 22 July letter was issued in error. There was no decision made on 22 July 2021 in respect of the claimant’s entitlement, whether under either section 8 or section 10 of the Social Security Act 1998. There was, therefore, no right of appeal to the First-tier Tribunal. District Tribunal Judge Ly struck the proceedings out for lack of jurisdiction (the “strike out decision”).
