Regulation 24AA as a temporary measure tied to the appeals process

28. Regulation 24AA is not a free-standing power to certify removal. It is parasitic on there being an “appeals process” (24AA(2)). Thereby its scope is limited jurisdictionally and temporally. It is limited jurisdictionally by being tied to the actuality or possibility of an appeal: regulation 24AA (2) provides that directions for removal may only be given if the Secretary of State certifies that “despite the appeal process not having been begun or not having been finally determined, removal of P pending the outcome of the appeal ...“ The temporal limits to its scope are that there must be the possibility of an
