    Whether the child would be leaving the UK with their parent(s)

    It is generally the case that it is in a child’s best interests to remain with their parent(s). Unless special factors apply, it will generally be reasonable to expect a child to leave the UK with their parent(s), particularly if the parent(s) have no right to remain in the UK; c.

    • First, the decision maker must consider whether the applicant meets the requirements of the Rules and if they do so leave under the Rules should be granted.
