[2015] EWCA Civ 13 where it was confirmed that there was no general obligation on the Secretary of State to give notice to an applicant for leave to remain or to the Tier 4 sponsor that she considers there to be a deficiency in the Confirmation of Acceptance for Studies before making an adverse decision on that basis. It was noted that it had been said in Kaur that the points-based system was designed to achieve predictability, administrative simplicity and certainty and did so at the expense of discretion, that is to say it was prescriptive.
