The Secretary of State appeals with the permission of First-tier Tribunal Judge Saffer against the decision of First-tier Tribunal Judge Freer. By his decision of 9 February 2022, Judge Freer (“the judge”) allowed the appeals of Mr and Mrs Nagdev against the Secretary of State’s refusal of their applications for permanent residence cards under regulation 21(5) of the Immigration (European Economic Area) Regulations 2016 (“the 2016 Regulations”). Those applications were made on 5 November 2020 and were refused by the Secretary of State on 4 January 2021.

To avoid confusion, we will refer to the parties as they were before the First-tier Tribunal: Mr and Mrs Nagdev as the appellants and the Secretary of State as the respondent.
