The judgment of Mostyn J in Akinsanya was appealed to the Court of Appeal ([2022] EWCA Civ 37). The Court of Appeal accepted that, under EU law, the Secretary of State was entitled to exclude from a “Zambrano” right, a person who has only limited leave to enter or remain. However, the Secretary of State’s appeal was dismissed because the Court held that the Secretary of State might have misunderstood Regulation 16(7) when framing the definition in Appendix EU to the Immigration Rules of “a person with a Zambrano right to reside”. The case was therefore concerned with the interplay between Regulation 16(7) and the EU Settlement Scheme (EUSS). This appeal is not concerned with EUSS. The application was one made and decided under the EEA Regulations. Accordingly, Akinsanya is of no relevance.
