The FTT granted permission to appeal on the broad ground that it was arguable that it had been wrong to determine that the application had no reasonable prospect of success and ought to be struck out.
It refused permission to appeal on three other grounds. The leaseholders renewed their application for permission on those additional grounds when they filed their notice of appeal and I directed that whether permission to appeal should be granted would be considered at the hearing of the appeal.
