This is an appeal from the First-tier Tribunal’s refusal to make a costs order under section 88 of the Commonhold and Leasehold Reform Act 2002, where the respondent RTM company had issued proceedings against the appellant as landlord, claiming the right to manage, but had then withdrawn its claim.

The appeal has been determined under the Tribunal’s written representations procedure; the appellant has been represented by Mr Justin Bates of counsel. The respondent has not been legally represented but its grounds of opposition were expertly drafted.
