This is an appeal from a decision of the First-tier Tribunal that the respondent is entitled to acquire the right to manage the building at 307 Barking Road, London E13. The appellant freeholder challenges that decision on the basis that the internal floor area of the non-residential parts of the building exceeds 25% of the internal floor area of the premises. The Tribunal therefore has to look at the requirements of paragraph 1 of Schedule 6 to the Commonhold and Leasehold Reform Act 2002.

The appellant was represented in the appeal by Mr Thomas Cockburn and the respondent by Mr Stan Gallagher, both of counsel, and we are grateful to them. We visited the building on 11 November 2024 and we thank the parties for allowing us access.
