The grounds of appeal
When this Tribunal granted permission to appeal, it described the grounds of appeal as “discursive”. They comprised 24 pages of argument commencing with a lengthy section headed “in brief”. Mr Hart took every point that was fairly available to him, but the Tribunal organised those points into three grounds and Mr Hart presented the appeal on the same basis. The issues in the appeal are therefore:
whether any order should have been made against Mr Shah;
whether the FTT had erred in finding that there was no reasonable excuse for the failure to obtain an HMO licence; and
whether the FTT’s decision about the quantum of the repayment order was based on findings of fact that were not justified on the evidence before it.
