Introduction

Introduction

1.

This is an appeal from a decision of the First-tier Tribunal (“the FTT”) about whether service charges are payable in respect of a leasehold flat; specifically, the issue is whether the appellants, as joint leaseholder of Flat 2, Brambridge House, are liable to pay service charges in respect of the common parts of the building. There is no challenge to the reasonableness of any charge and so the appeal turns on the construction of the lease. The respondent, BHRM Limited, is the freeholder and has chosen not to take part in the appeal, which has been decided under the Tribunal’s written representations procedure. The appellants were not legally represented.
