The Applicant seeks permission to challenge the decision of District Judge Matson dated 31 January 2025 ordering his extradition to Romania. This is a renewed application, permission to appeal having been refused on the papers by Mr Justice Bourne on 20 May 2025.

In addition to the renewed application for permission there is an application, dated 5 August 2025, for prior authority to extend the representation order to cover a report prepared by a clinical psychologist into the mental health of the Applicant’s wife, and the impact of extradition on her and their son. This goes to the Article 8 ECHR ground advanced by the Applicant.

Because of this application for further evidence, the Applicant also sought to vacate the renewal hearing on 21 August 2025 so that a report could be prepared, and updated submissions filed. I indicated at the hearing that I intended to hear the Applicant’s submissions on the substantive merits of the application for permission, since they included distinct grounds under Section 2 of the Extradition Act 2003 and Article 5 of the ECHR, before deciding whether to grant the application for further expert evidence or considering whether the permission hearing should be adjourned in respect of some or all of the grounds relied on.
