I allow the appeal in respect of grounds 5(i) and 5(ii) and (so far as it applies to the conduct underlying ground 5(i)) ground 3. I therefore set aside the findings of the PCC that Mr Mobasseri was dishonest in respect of the inappropriate and misleading claims for treatment in respect of Patients B, C, D, F and K.

Otherwise the appeal is dismissed. The sanction that Mr Mobasseri’s name be erased from the Register stands.
