Ms Carlo’s Third Witness Statement sets out her views of the policy and its effects. The Defendant properly accepted that the Witness Statement should be considered by the court de bene esse and I shall allow the Claimants’ application to rely on it to this extent. Its relevance to the issues in the claim, and the weight to be attributed to the evidence contained within it, will be for the court to determine in due course.
