Resulting trust
Where property is purchased and transferred into the name of someone other than the purchaser:
A resulting trust arises in favour of the purchaser if he establishes that his actual intention was that the legal owner was not to be the beneficial owner; or
In the absence of evidence of actual intention, it is presumed that a resulting trust arises.
