For all the above reasons I order that:

The Defendant shall pay the Claimant’s costs of these proceedings, to be assessed forthwith on the indemnity basis if not agreed.

ii)

There shall be no order as to the costs of the Disclosure Application such that each party is to bear their own costs of that application.

iii)

The Defendant shall pay the Claimant the sum of £660,000 on account of the costs ordered to be paid by sub-paragraph (i) above within 21 days of the date of the court’s order.

If the parties can provide a final version of draft order which is in the hearing bundle with any corrections to this judgment, I will approve the order for handing down with the judgment.
