The issue for the tribunal to determine is whether the Commissioner’s Decision Notice was in accordance with the law and whether the Commissioner was correct in finding that the Council had made all relevant information available to the Appellant and had complied with regulation 5(1) of the EIR.

We read and took account of an open bundle containing 326 pages including indexes.

We also heard submissions from the Appellant.
