The role of the Tribunal
Pursuant to regulation 18 of the EIR, the enforcement and appeals provisions of the Freedom of Information Act 2000 shall apply (subject to the modifications in regulation 18) for the purposes of the EIR. As such, the Tribunal must consider whether the decision made by the Commissioner is in accordance with the law or, where the Commissioner’s decision involved an exercise of his discretion, whether he ought to have exercised it differently. The Tribunal may receive evidence that was not before the Commissioner and may make different findings of fact from the Commissioner.
