Conclusion on the trade marks issues
To conclude in relation to the trade mark issues, subject to the issue of joint tortfeasance considered below, I find that the Defendants’ activities constituted infringements of the Claimant’s Marks and that the Defendants do not have a defence under either s.11 or s.12 of the Trade Marks Act 1994.
