Conclusion
For the reasons set out above:
I find that the First Defendant is liable for infringement of the Claimant’s Marks.
I dismiss the copyright infringement claim against the First Defendant.
I find that the Second Defendant is not liable as a joint tortfeasor in relation to the First Defendant’s infringing acts;
I dismiss the Defendants’ counterclaim.
