In light of our findings on errors of fact and our decision that the barring decision will need to be remitted for reconsideration, there is no need for us to consider whether the Respondent's decision to include the Appellant on the Children's Barred List was, based on the original five findings of relevant conduct, disproportionate.

Nonetheless, we record some of the evidence and submissions received. The Tribunal heard evidence from the Appellant, SH and AF about the severe, wide-ranging and ongoing impact of the barring decision on the Appellant, not just in his ability to foster again but also in restricting his volunteering opportunities with children. The question of whether the Appellant is entitled to have contact with DM as a friend, given that DM is now an adult in law and the Appellant no longer has a fostering relationship with him, appears now to be resolved.
