Taking all the circumstances into account, we are satisfied that the TC’s decision was plainly wrong and as a result, the appeal is allowed as per the test in Bradley Fold Travel & Peter Wright v Secretary of State for Transport (2010) EWCA Civ.695. The appeal is allowed.
