NOTICE OF DECISION
The FTT decision involved the making of an error of law and is set aside.
The appeal is remitted to the FTT to be redecided at a hearing before a salaried FTT judge to determine the following issues:
whether the appellant’s continuous qualifying period, which began before and continued at the specified date, has since been broken;
or alternatively (if the appellant has grounds so to argue) that he is excused from the requirement that his continuous qualifying period must continue until the date of application.
