Conclusions
Our Overall Conclusion
Whilst we do not consider that Tenet’s investigation into Mr Ashraf justified the reference they provided to the Authority, there is, as we concluded at [109], more than sufficient other evidence before us to place the Decision well within the spectrum of regulatory responses open to the Authority.
Disposition
For the reasons set out above, we are satisfied that the Decision was one which was reasonably open to the Authority.
The Reference is dismissed.
