LEGITIMATE USE

106. That is not however the end of the matter. Whilst the Claimant cannot stop the Defendants from using information that is in the public domain or which is part of their gathered knowledge and expertise they can stop illegitimate use of the information.107. It is well established that if an ex-employee deliberately copies or even deliberately memorises information for use post termination that is illegitimate and the ex-employees can be restrained from so acting. It is no defence to a claim for breach of an implied obligation of good faith and fidelity and breach of confidence for an employee who has taken a customer list to say that some or all of the information on the list is publicly available see
