The Law
35.The basic principles set out in the Children Act 1989 are extremely well known. In any decision about the upbringing of the child, the paramount consideration for the Court is the child’s welfare (s1(1)).36.There is a presumption that unless the contrary is shown, the involvement of a parent in the life of a child will further the child’s welfare (s.1(2A)).37.In considering the child’s welfare, the Court will have regard to the welfare checklist in s.1(3).
