It breached his rights under EU law. S claimed he benefitted from protection under the Immigration (European Economic Area) Regulations 2016 (the “2016 Regs”) on the basis he had exercised treaty rights for at least five years and had been continuously resident for at least ten years, with the date of the offence being pre-31 Dec 2020.
It would breach his Article 8 rights (relationship with daughter and partner)
