There have been two case management hearings in these appeals with a view to identifying the issues. These were to a substantial extent agreed. The AIRE centre was also granted permission to intervene.
The issues as identified in each of the appeals are set out in the form settled by the Upper Tribunal in the annex to this decision.
Subsequent to the hearing, and before an embargoed draft was circulated to the parties, the Court of Appeal handed down SSHD v AA(Poland) [2024] EWCA Civ 18. The SSHD drew attention to that decision in the response to the draft, and the panel then gave directions for written submissions on that case to be served. We have taken them into account in reaching our decision.
