Real Risk of More Severe Punishment due to Nationality in CAR Prisons under section 81(b) or on the basis of sexual orientation
The Applicant contends that the Court can now find a real risk of him being punished more severely as a foreigner in a privately operated CAR prison. This risk was said to arise from governmental prison policy and is supported by evidence adduced before the SDJ and fresh evidence concerning the revival of privatised prisons by Presidential edict.
The Applicant also alleges prejudice in his conditions of detention by reason of sexual orientation and the potential housing of the Applicant in an SHU for his protection, with the argument that such conditions would be disproportionately severe.
