I agree with the simple submission by Mr Head KC for the DWF Ds that the mismatch between (ii) and (iii) should mean that the pleaded deceit claim would fail. If the representation pleaded and understood by the council to have been made was not made in the first place (objectively speaking), the pleaded claim would fail in limine; if (objectively) that representation was made, the pleaded claim would fail because the defendant did not intend to mislead by any such statement, and the false statement they intended to make about having a Mayoral invitation to attend had no impact (if indeed it can be said to have been made at all).
