We have found as a fact that it is relatively straightforward to access the dark web, so that DBS was wrong to say that the appellant “went to great lengths” to do this. However, this is immaterial. What matters is that the appellant did not accidentally stumble on the dark web. He went there deliberately as we have set out in our findings of fact.
