We deal first with the six alleged mistakes of fact in DBS’s decision. We approach these in the light of the evidence and our findings of fact as set out above. In each case, we consider first whether there was a mistake in DBS’s decision and then whether that mistake is material, whether individually or cumulatively with any of the other errors. We then deal with the ground of appeal based on proportionality.
