Permission to Appeal
1. The principal ground upon which permission to appeal to this Tribunal was granted was that of the conduct of the hearing at first instance. The permission judge refers to the witness statement of Mr Lingajothy, counsel who represented the Appellant at first instance and states “… in light of its contents it is arguable that the decision of the First-tier Tribunal (The “FtT”) was vitiated by procedural unfairness through apparent bias.” 2. While, as the grant of permission makes clear, apparent bias lies at the heart of this appeal, permission was granted in respect of several wide ranging grounds and there is at least one further discrete issue of substance to be considered.
