The evolution of the measures under challenge
The CLRA 2002 and the more limited amendments which followed it did not bring an end to the enduring topic of leasehold reform. In July 2016, the Law Commission began consultation on its Thirteenth Programme and identified leasehold as a potential area for reform. That heralded a period of intense scrutiny of this issue, by the Law Commission and various bodies, which led up to the LFRA 2024. Both sides have referred to parts of that material that they wished to emphasise. Even in a judgment of this length, it is impossible for us to capture every possible reference which might assist either side. Instead, we have sought to give a fair summary of the overall content of this material with a level of detail appropriate for understanding the objects of the reforms and their justification as inputs to the A1P1 enquiry. But throughout we have borne in mind the need to read the material as a whole.
