In consequence, I conclude that how the Romanian authorities would approach early release of the appellant in the context of his having been a fugitivity from Romanian justice for several years must be speculation. That is impermissible. The Supreme Court emphasises the need for evidence and an “overwhelming probability” of result. This is completely absent. Therefore, I can attach little if any meaningful weight to the theoretical possibility of the appellant’s early release.
