Submissions
The appellant submits that the “little weight” that the Supreme Court in Andrysiewicz says can be attached to early release unless the specified conditions are met does not mean no weight can be attached to the Romanian early release conditions. It is submitted that these release conditions “would be considered in Romania”.
The respondent submits that the position is clear following the Supreme Court’s decision: no meaningful weight can be attached to the mere existence of the Romanian Criminal Code provisions without clear evidence about their effect and implementation.
