Ms. Renton submitted that the high threshold was considered “pragmatically” by Mr Dias QC in ST v QR at [25]:

… It is emphasised that “the threshold is high”. But let me stress that I take none of this to mean that the bar should be impossibly high or unattainable. Equally, I do not compare this case to other cases and consider whether this is a rare case or not. Such forensic comparison is of little use to me. Instead, I simply consider whether there is a fundamental chance of circumstances as a question of fact. If so, I must and will redetermine the substantive application. Nothing more, nothing less.
