The law relating to an application to set aside an order under the Hague Convention 1980 was set out in Re B (A Child: Abduction: Article 13(b)) per Moylan LJ which in turn cited from Re W (Abduction: Setting Aside Return Order) [2019] 1 FLR 400. At [37] of the latter judgment Moylan LJ stated he would “express the test as beingwhether there has been a fundamental change of circumstances which sufficiently undermines the basis of the court’s decision and order to require the application to be reheard.”
