Second, Mr. Glasson KC considered M’s mental health. He emphasised that the question was not whether or not a return to Poland would expose M to psychological harm but whether or not the impact on M’s psychological health would be such as to expose the children to a grave risk of psychological harm such that they would be in an intolerable situation. He took into account the unchallenged diagnosis by Dr. Pickering that M had “severe depression and anxiety” and symptoms which were indicative of a “severe depressive disorder”. He also took into account that overall Dr. Pickering’s evidence was that M’s mental health would deteriorate on a return to Poland.
