This Judgment does not address any issues concerning interest or costs.1 Although Mr Greig and Mrs Rawlin were keen to emphasise that this sum was simply the result of Brit Inns’ forecast, and was not the subject of a formal claim, I reject that rather fine distinction, at least for present purposes. The size of the forecast troubled Mr Greig precisely because he feared that it would form the basis of Brit Inns’ claim.2 The instruction came, according to her report, from Mr Barber. 3 In short, it was the date that Brit Inns achieved the relevant gross profit levels (in percentage terms) agreed between the experts.
