137.

As regards the specific circumstance of time to pay, unless excluded by the contract of guarantee, the guarantor is discharged where:

(1)

there is a binding agreement between the creditor and the debtor to give the debtor time to pay (Marubeni Hong Kong and South China Ltd v The Mongolian Government [2004] EWHC 472 (Comm) at [168]);

(2)

the guarantor has not consented.

The policy behind this rule is that it deprives the guarantor of the right to use the name of the creditor to sue the principal. A short extension, which does not injure the guarantor in any financial terms and may in fact benefit him, still results in discharge.
