On the facts of the present case , the Secretary of State submitted that on her own evidence the appellant was fully aware of what was taking place within the prison and that she had taken no steps to distance herself or to avoid participation. It was pointed out that she had been away from work for a period of maternity leave and had returned voluntarily. It was pointed out that she had subsequently been promoted, that she had never asked to resign or sought a transfer to a different post and the totality of the evidence suggested that she participated voluntarily in her duties.
