The terms of the IDDQD agreement other than the RMG EUT
The allegation by IDDQD that Mr Smith is in breach of the substantive terms of the agreements between IDDQD and Mr Smith is only in respect of the 2021 and 2022 terms. At the trial the defendants admitted that both sets of terms prevented the defendants from making any commercial re-use of IDDQD’s data, in particular to compete with IDDQD. Mr Smith is in breach of those terms subject to defences considered below.
