Another argument was newly raised in the defendants’ opening skeleton: even if Mr Smith was the contracting party the agreement licensed both him and Codeberry. IDDQD did not file evidence or otherwise come to court to meet the point so I will not consider it further. I add only that it not evident that the terms of the agreements provided for a licence to third parties.
