As a result of this I have not had to determine whether the date of unlawful retention was 27th June 2024 (F’s primary case) or one of 19th June 2024 or 6th September 2024 (F’s secondary case) or late September 2024 (M’s case). It was accepted by M that on whatever date the retention occurred it was unlawful and by both parties that the date has no direct bearing on M’s Article 13(b) defence. In relation to the latter there was a recital to this effect at paragraph 11 of my order of 1st July 2025.
