Ms Skander submitted that the Scheme was prescriptive in nature, that words were to be given their ordinary meaning and that paragraph 42 was to allow for a fact specific analysis; it allowed the decision maker some discretion when considering which particular facts might be taken into account. A non-controversial example of that was the reference to “any other factors and contingencies which appear relevant” when determining the relevant period.
