“We found that the costs of an extension (or indeed adaptation) to Mrs Treacy’s house was not a resultant loss because it did not arise due to the loss of parental services.”

That was a continuation of the previous error of law. Had the Tribunal applied the ordinary everyday meaning of the word “other”, noting that it was in a prescriptive scheme, to a paragraph where the draftsmen had intended the decision maker to use some discretion, the finding in question could not have been made.
