The Applicant relied upon his interpretation of paragraph 42(b) of the Scheme in order to assert there had been an error of law in not permitting recovery of those further costs. As stated above, CICA’s position was that the Applicant’s interpretation of paragraph 42(b) was erroneous.

Those costs could not be characterised as a cost to replace the care of the Applicant by his mother, rather they might potentially come about because civil and/or CICA claims have been pursued and awarded. Paragraph 42(b) did not apply to the item claimed.
